Please read these Terms before using MiYo Gift. By accessing or using the Service, you agree to these Terms and to our Privacy Policy.

In Simple Words

MiYo Gift lets you preview, create, customize, publish, and share digital gifts.
Sample gift links may be previewed or shared without creating a personalized version. Membership is required when you create your own personalized gift.
Membership plans include different numbers of gift creations. Each personalized gift creation uses one creation benefit.
Your gift can be shared by link, poster, or scheduled email delivery. If you do not set an access password, anyone with the link may be able to view it.
AI text generation is optional and only runs when you actively request it in the gift editor.
Payments are processed by Creem and PayPal. MiYo Gift does not store sensitive payment credentials.
MiYo Gift is a digital product with preview access before purchase, so memberships and used creation benefits are generally non-refundable.
You must be 18 or older to use the Service.

These Terms of Service ("Terms") govern your access to and use of the MiYo Gift website (miyogift.com), gift editor, templates, AI-assisted text generation, payment features, scheduled delivery, and related services (collectively, the "Service").

"MiYo Gift", "we", "us", and "our" refer to MiYo Gift as the operator of the Service. If an operator or company name is legally required in a specific context, it may be identified as MiYo Gift unless a separate legal entity is later provided.

If you do not agree to these Terms, please do not use the Service.

2. Age Requirement

You must be at least 18 years old, or the age of legal majority in your jurisdiction if that age is higher, to use MiYo Gift. By using the Service, you represent that you meet this requirement.

We do not knowingly provide the Service to minors. If we become aware that a user under 18 has provided personal information or created an account, we may delete the account, gift content, and related data.

3. Service Description

MiYo Gift is a digital gift creation and delivery platform. The Service may include:

Sample gift preview — You may preview or share sample gift experiences before subscribing or creating a personalized gift.
Gift templates — Templates designed, arranged, or curated by MiYo Gift for different occasions and emotional tones.
Customization — You may personalize text, photos, videos, music, dates, and other fields in the editor.
AI-assisted text generation — For text fields, you may choose to generate suggested text by clicking the AI generation button and providing optional context.
Gift link and poster sharing — Published gifts may be shared using a unique link or share poster.
Access password — You may optionally protect a gift with an access password.
Scheduled email delivery — You may enter a recipient email address and delivery time so the system can send the gift link at the selected time.
Membership plans — Paid membership plans may include different numbers of personalized gift creation benefits.

Features may change over time. Some features may be free, while others require a membership, one-time purchase, or other paid entitlement.

4.1 Account and Session Responsibility

You are responsible for keeping your account, login method, device, and gift links secure. You must not share access in a way that violates these Terms or exposes another person's private information without permission.

4.2 Gift Links

Gifts are accessed through unique links. If no access password is set, anyone who obtains the link may be able to view the gift. Share links only with people you trust.

4.3 Access Passwords

If you set an access password, you are responsible for choosing and sharing it carefully. MiYo Gift processes gift access passwords using secure methods such as hashing, but no access-control method is perfect.

4.4 Scheduled Delivery

If you schedule delivery by email, you are responsible for entering the correct recipient email address and for having a reasonable basis to send the gift link to that recipient. MiYo Gift is not responsible for failed, delayed, or misdirected deliveries caused by incorrect recipient information, email provider limitations, spam filtering, network issues, or events outside our reasonable control.

4.5 Public Showcase Pages

Public demo or showcase pages display example gifts created or curated by MiYo Gift for demonstration unless otherwise stated. Your personal gifts are not intended to be made publicly searchable by other users.

5. User Content

5.1 Ownership

You retain ownership of the content you upload or enter into your gifts, including your text, images, videos, music, names, dates, and personal notes.

5.2 License to Operate the Service

To provide the Service, you grant MiYo Gift a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, render, display, transmit, and otherwise use your content solely as needed to:

Create, edit, publish, display, and deliver your gift;
Provide support and troubleshoot issues;
Maintain security and prevent abuse;
Comply with legal obligations and enforce these Terms.

You may end this license for future use by deleting your gift or account where deletion controls are available, subject to reasonable backup, security, legal, payment, and audit retention.

5.3 Your Responsibilities

You represent and warrant that:

You have all rights, permissions, and consents needed to upload and share your content;
Your content does not infringe copyright, trademark, publicity, privacy, reputation, or other rights;
You have permission to use portraits, names, personal stories, music, videos, and other media included in your gift;
Your content is not unlawful, deceptive, threatening, harassing, hateful, defamatory, obscene, exploitative, or otherwise harmful.

6. AI-Assisted Text Generation

MiYo Gift may provide optional AI-assisted text generation in the gift editor. This feature is available for text fields and only runs when you actively click the AI generation button and submit context.

You understand and agree that:

AI-generated text is a suggestion, not a final message from MiYo Gift.
You are responsible for reviewing, editing, accepting, rejecting, and using any generated text.
AI output may be inaccurate, unsuitable, repetitive, incomplete, or similar to content generated for other users.
You should not submit sensitive personal information, confidential information, or information you do not have permission to use.
You are responsible for ensuring the final gift content is lawful, appropriate, and respectful of third-party rights.

MiYo Gift may limit, modify, suspend, or remove AI-assisted features at any time.

7. Prohibited Conduct

You must not:

Upload, publish, send, or share content that infringes intellectual property, privacy, publicity, or other rights;
Upload or share unlawful, abusive, hateful, violent, sexually exploitative, harassing, deceptive, defamatory, or malicious content;
Use the Service to collect, expose, or distribute another person's personal information without permission;
Use AI-assisted generation to create unlawful, abusive, deceptive, or rights-infringing content;
Attempt to access accounts, gifts, systems, APIs, databases, or infrastructure without authorization;
Reverse engineer, scrape, crawl, overload, interfere with, or misuse the Service;
Circumvent payment, membership, creation limits, access controls, or security measures;
Impersonate any person or misrepresent your affiliation with any person or entity;
Use the Service in violation of applicable law.

8. Membership, Payments, and Refunds

8.1 Membership Model

MiYo Gift uses a membership model. Different membership plans may include different numbers of personalized gift creations. Each time you create a personalized gift, one creation benefit may be used.

Sample gift preview and sample gift link sharing may be available without membership. Membership is required when you create your own personalized version.

8.2 Payment Providers

Payments are processed by Creem and PayPal. By completing a payment, you also agree to the applicable terms and privacy policies of the payment provider you use.

MiYo Gift does not store sensitive payment credentials such as card numbers, CVV codes, bank account information, or payment account passwords. We may store transaction IDs, payment status, amount, currency, timestamps, payment provider, and the membership or creation benefits associated with the purchase.

8.3 Pricing and Taxes

Prices, included benefits, currencies, and taxes are displayed on the relevant product or checkout pages. Prices and plans may change over time. Changes do not affect purchases already completed unless stated otherwise or required by law.

8.4 Refunds

MiYo Gift is a digital product with preview access available before purchase. For that reason, memberships and used creation benefits are generally non-refundable.

We recommend reviewing the sample gift experience before purchasing. If you experience a payment error, duplicate charge, failed activation, or technical issue that prevents use of purchased benefits, contact us at hi@miyogift.com and we will review the issue. Nothing in this refund section limits mandatory consumer rights that cannot be waived under applicable law.

9. Content Moderation and Account Actions

MiYo Gift does not routinely pre-screen user-created gifts. However, we may remove, restrict, suspend, or terminate access to content, gifts, benefits, or accounts if:

We receive a valid copyright, privacy, abuse, or legal complaint;
We believe content violates these Terms or applicable law;
We detect fraud, payment abuse, security risk, or platform misuse;
Action is necessary to protect MiYo Gift, users, recipients, third parties, or the Service.

Where appropriate, we may report serious unlawful activity to relevant authorities.

10. Intellectual Property

MiYo Gift owns or licenses the Service, including the website, editor, software, interface design, template arrangements, visual compositions, branding, original copy, and other platform materials.

You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, clone, or commercially exploit the Service or platform materials except as expressly allowed by these Terms.

User content remains subject to Section 5. Copyright complaints are handled under our Copyright & Intellectual Property page.

11. Service Availability

We work to keep MiYo Gift reliable, but we do not guarantee that the Service will be continuous, uninterrupted, error-free, or permanently available.

The Service may be affected by maintenance, upgrades, hosting or network issues, Cloudflare routing or security events, payment provider issues, email delivery limits, AI provider or backend availability, force majeure events, or other circumstances outside our reasonable control.

You should keep your own copies of important text, images, videos, music, and other materials used in your gifts.

12. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

To the fullest extent permitted by applicable law, MiYo Gift is not liable for:

Indirect, incidental, special, consequential, punitive damages, or loss of profits;
Loss, exposure, deletion, or corruption of user content;
Third-party claims arising from content you upload, generate, publish, or share;
Gift access by unintended recipients where a link or password is shared, guessed, or exposed;
Failed, delayed, or misdirected scheduled delivery;
Payment provider errors, bank issues, or chargeback processing outside our control;
AI-generated output that you choose to use after review.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Governing Law and Disputes

Because MiYo Gift currently operates without a separate company entity, these Terms are intended to apply to the Service under the laws that are applicable to MiYo Gift's operation and to your use of the Service.

If a dispute arises, you agree to first contact us at hi@miyogift.com so we can try to resolve it informally. If informal resolution fails, disputes may be submitted to a court or authority with competent jurisdiction.

Your mandatory consumer rights under applicable law are not affected by these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date. For material changes, we may provide additional notice through the Service or by email where appropriate.

Your continued use of the Service after updated Terms take effect means you accept the updated Terms.
