Copyright & Intellectual Property

This policy explains the ownership of MiYo Gift platform materials, your rights and responsibilities for content you add to gifts, and how copyright or intellectual property concerns can be reported.

Last Updated: September 2026

1. MiYo Gift Intellectual Property

MiYo Gift owns or licenses the materials used to operate and present the Service, including the website, software, gift editor, branding, original copy, interface design, template arrangements, animations, visual compositions, graphics, and other platform materials that are not User Content.

These materials may be protected by copyright, trademark, unfair competition, and other applicable intellectual property laws.

Unless we expressly permit it, you may not copy, reproduce, republish, modify, redistribute, sell, license, scrape, clone, reverse engineer, or commercially exploit MiYo Gift platform materials in a way that infringes our rights or the rights of our licensors.

Copyright protects original expression and does not give MiYo Gift ownership over general ideas, themes, occasions, concepts, methods, or functionality that are not independently protected by law.

2. Templates, Designs, and Platform Content

MiYo Gift templates and sample experiences may combine original design work with licensed, royalty-free, stock, tool-assisted, or other lawfully sourced materials.

The selection, arrangement, visual composition, animation, copy, interaction design, and other original elements created by MiYo Gift may be protected even when individual underlying assets are licensed from third parties.

Third-party materials remain subject to the rights and license terms of their respective owners. Nothing in this Policy transfers ownership of third-party intellectual property to MiYo Gift or to users of the Service.

3. Your Gift Content Belongs to You

You retain ownership of the text, photographs, images, videos, audio, music, messages, names, dates, personal notes, and other content you upload or enter into your gifts ("User Content"), subject to any rights held by third parties in that content.

Uploading User Content to MiYo Gift does not transfer ownership of that content to us.

To operate the Service, you grant MiYo Gift the limited license described in our Terms of Service: we may host, store, process, reproduce, render, transmit, and display User Content only as reasonably necessary to provide the gift and related services you request, maintain security, provide support, enforce our Terms, or comply with legal obligations.

We do not acquire the right to sell your personal gift content or use a private gift as public advertising or marketing material merely because you created or hosted it with MiYo Gift.

4. Your Responsibility for Uploaded Content

You are responsible for ensuring that you have the rights, licenses, permissions, and consents necessary to upload, publish, and share User Content through MiYo Gift.

This responsibility may apply to, among other things:

  • photographs and portraits of other people;
  • videos and audio recordings;
  • music and sound recordings;
  • artwork, illustrations, and written material;
  • trademarks, logos, or brand materials;
  • names, personal stories, messages, and other information relating to another person.

Do not upload or distribute content if doing so would infringe another person's copyright, trademark, privacy, publicity, confidentiality, or other legal rights.

MiYo Gift does not routinely pre-screen every user-created gift. We may remove, disable, or restrict access to content when we receive a valid rights complaint, reasonably believe the content violates our Terms or applicable law, or need to protect users, recipients, third parties, or the Service.

5. Optional AI-Assisted Content

MiYo Gift may provide optional AI-assisted features, such as text suggestions, when you actively choose to use them.

AI-assisted output may not be unique and may be similar to material generated for other users. You are responsible for reviewing and editing output before using it and for determining whether your final use is appropriate and respects third-party rights.

MiYo Gift does not guarantee that AI-assisted output is copyrightable, unique, accurate, or free from third-party claims.

6. Unauthorized Copying, Scraping, and Cloning

You may not use MiYo Gift to systematically copy or extract our protected platform materials or private user gifts without authorization.

Depending on the circumstances, we may take reasonable steps to protect our rights or the rights of users and licensors, including restricting access, preserving relevant evidence, contacting service providers or platforms, submitting appropriate takedown requests, or pursuing other remedies available under applicable law.

This section does not prohibit lawful uses that cannot be restricted under applicable law.

If you believe content available through MiYo Gift infringes a copyright you own or are authorized to enforce, contact:

hi@miyogift.com

Please provide enough information for us to understand and evaluate the complaint, including:

  • your name and contact information;
  • identification of the copyrighted work you believe has been infringed;
  • the URL or other information sufficient to locate the allegedly infringing material on MiYo Gift;
  • an explanation of why you believe the use is unauthorized;
  • a statement that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner; and
  • a physical or electronic signature where required.

A clear subject line such as Copyright Complaint — Brief Description can help us route the request appropriately.

We may request additional information where reasonably necessary to evaluate the complaint.

8. DMCA Notices and Counter-Notifications

Where the United States Digital Millennium Copyright Act (DMCA) applies, a copyright owner or authorized agent may submit a notification that satisfies the requirements of 17 U.S.C. § 512 (c)(3).

If material you submitted is removed or disabled in response to a DMCA notice and you believe that happened because of mistake or misidentification, you may submit a counter-notification containing the information required by applicable law, which may include:

  • identification of the material removed or disabled and its previous location;
  • your contact information;
  • a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification;
  • any jurisdiction and service-of-process statements required by the DMCA; and
  • your physical or electronic signature.

Send applicable notices or counter-notifications to hi@miyogift.com with a clear subject line identifying the request.

Submitting a knowingly false or materially misleading copyright notice or counter-notification may create legal liability.

9. Other Intellectual Property Complaints

If your concern involves a trademark, publicity right, privacy right, impersonation, or another intellectual property or personal right rather than copyright, contact hi@miyogift.com and include the relevant URLs, screenshots, explanation, and information showing your connection to the right at issue.

We will review the request and may ask for additional information before taking action.

10. Repeat or Serious Infringement

Where appropriate, MiYo Gift may restrict or terminate access to gifts, features, or the Service for users who repeatedly infringe third-party intellectual property rights or engage in serious rights violations.

We may consider the nature of the complaint, available evidence, prior notices, counter-notifications, applicable law, and other relevant circumstances.

11. Changes to This Policy

We may update this Copyright & Intellectual Property Policy as the Service or applicable legal requirements change. The current version will be posted on this page with a revised "Last Updated" date.
