# Terms of Service > These Terms of Service govern your use of MiYo Gift. By accessing or using the Service, you agree to these Terms and > our Privacy Policy. **Last Updated: September 2026** --- ## In Simple Words * MiYo Gift is free to use for creating, editing, previewing, and publishing personalized digital gifts. * Optional paid features and benefits are available when you choose to activate them. Free use does not mean that every feature is free. * You can use MiYo Gift without creating a traditional account. We may assign an Account ID to help maintain your gifts, purchases, and service continuity. Optional sign-in features may also be available. * Published gifts use unique private links. Anyone who obtains a link may be able to open the gift unless you enable password protection or another access control. * You keep ownership of the content you add to your gifts. You must have the rights and permissions needed to use and share that content. * Optional AI-assisted features only run when you choose to use them. You remain responsible for reviewing and using any generated output. * Payments for optional Paid Benefits are handled by third-party payment processors. MiYo Gift does not store your full payment card details. * Refunds are governed by our [Refund Policy](/refund-policy), including the standard 14-day refund window for eligible unused Paid Benefits. --- ## 1. Acceptance of Terms These Terms of Service ("Terms") govern your access to and use of the MiYo Gift website, browser-based gift editor, templates, publishing features, private gift pages, optional paid features, scheduled delivery, support services, and related functionality (collectively, the "Service"). "MiYo Gift", "we", "us", and "our" refer to the operator of the Service. If you do not agree to these Terms, do not use the Service. --- ## 2. Eligibility You must be at least 18 years old, or the age of legal majority in your jurisdiction if that age is higher, to use the Service. By using MiYo Gift, you represent that you meet this requirement and are legally able to agree to these Terms. If we learn that the Service has been used in violation of this requirement, we may restrict access or remove related data where appropriate. --- ## 3. The MiYo Gift Service MiYo Gift is a browser-based personalized digital gift creator. Depending on the template and features you choose, the Service may allow you to: * create and personalize gifts with text, photos, videos, audio, music, dates, and other content; * edit and preview a gift before and after publishing where supported; * publish a personalized gift and access it through a unique gift link; * optionally add password protection; * share a gift through supported methods such as a private link or QR code; * schedule supported delivery methods, such as sending a gift link by email; * use optional AI-assisted text features when you actively request them; and * purchase optional Paid Features or Paid Benefits when you want additional capabilities. ### 3.1 Free Creation Layer MiYo Gift is free to use for creating, editing, previewing, and publishing personalized gifts. You do not need to purchase a Paid Benefit to complete those core creation steps. Some additional capabilities may require payment. The features, benefits, price, duration, limitations, and other terms of a paid offering are shown at the time you choose to purchase or activate it. ### 3.2 Changes to the Service We may add, modify, replace, limit, or discontinue features over time. We will not intentionally describe a paid purchase as including a benefit that was not offered to you at the time of that purchase. --- ## 4. Account ID, Optional Sign-In, and Gift Access ### 4.1 Account ID MiYo Gift may assign you an Account ID when you use the Service. This allows core features to work without requiring a traditional account registration. You are responsible for maintaining access to the browser, device, sign-in method, or other credentials you use with MiYo Gift. Clearing browser data, changing devices, or losing access to an optional sign-in method may affect continuity for information associated with your current session or Account ID. ### 4.2 Optional Sign-In Where sign-in is offered, it is optional unless a particular feature clearly requires it. If you use a third-party sign-in provider, that provider's terms and privacy practices also apply to the authentication process. ### 4.3 Private Gift Links Published gifts use unique links designed to be difficult to predict or enumerate. These links are intended for sharing with people you choose, but possession of an unprotected link may allow access to the gift. You are responsible for sharing gift links carefully. MiYo Gift cannot control what a recipient does with a link after you send it. ### 4.4 Password Protection If you enable password protection, recipients must provide the correct password before accessing protected gift content. You are responsible for choosing and sharing the password appropriately. No technical safeguard can provide an absolute guarantee of secrecy or prevent a recipient from copying or redistributing content after they have legitimately accessed it. ### 4.5 Scheduled Delivery If you use a scheduled delivery feature, you are responsible for providing the correct recipient information and for having a reasonable basis to contact that recipient. Delivery may be delayed or fail because of incorrect information, filtering, provider limitations, network issues, or circumstances outside our reasonable control. --- ## 5. User Content ### 5.1 Your Ownership You retain ownership of the text, photos, videos, audio, music, names, dates, messages, and other content you upload or enter into your gifts ("User Content"). ### 5.2 Limited License to Operate the Service To provide MiYo Gift, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, render, transmit, and display your User Content only as reasonably necessary to: * create, edit, preview, publish, host, and deliver your gift; * provide features you request; * provide customer support and troubleshoot problems; * maintain security, prevent abuse, and enforce these Terms; and * comply with legal obligations. This operational license does not transfer ownership of your User Content to MiYo Gift. We do not gain the right to sell your personal gift content or use a private gift as public marketing material merely because you uploaded it to the Service. ### 5.3 Your Responsibilities You represent and warrant that you have the rights, permissions, and consents needed to upload, publish, and share your User Content. You must not use the Service to publish or distribute content that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights, or that is unlawful, abusive, exploitative, threatening, deceptive, defamatory, or otherwise prohibited by applicable law. Optional AI-Assisted Features MiYo Gift may provide optional AI-assisted features, such as text suggestions in the editor. These features run only when you actively choose to use them and submit the relevant context. When you use an AI-assisted feature: * generated output is a suggestion and may be inaccurate, incomplete, repetitive, unsuitable, or similar to output generated for others; * you are responsible for reviewing, editing, accepting, rejecting, and using the output; * you should not submit confidential or sensitive information that you do not want processed for the requested feature; and * you remain responsible for ensuring the final content is lawful and does not infringe third-party rights. We may change, limit, suspend, or remove optional AI-assisted features at any time. --- ## 7. Prohibited Conduct You must not: * upload, publish, or share unlawful or rights-infringing content; * use MiYo Gift to harass, threaten, impersonate, deceive, exploit, or harm another person; * expose or collect another person's personal information without an appropriate basis or permission; * attempt to gain unauthorized access to gifts, accounts, Account IDs, systems, APIs, databases, storage, or infrastructure; * guess, enumerate, scrape, crawl, copy, or systematically collect private gift content without authorization; * bypass password protection, paid-feature controls, security measures, rate limits, or other access restrictions; * interfere with, overload, damage, reverse engineer, or misuse the Service; * use automated systems in a way that creates unreasonable load or violates access restrictions; or * use the Service in violation of applicable law. --- ## 8. Paid Features, Payments, and Refunds ### 8.1 Optional Paid Features and Benefits The core creation flow described in Section 3.1 is free. MiYo Gift may offer optional Paid Features or Paid Benefits that provide additional capabilities. The details of each paid offering are presented before purchase. We do not tie these Terms to specific plan names, prices, quantities, or feature bundles because those offerings may change over time. Unless a checkout page clearly states otherwise, a one-time purchase does not automatically renew. ### 8.2 Payment Processing Payments are processed by the third-party payment provider shown at checkout. By completing a payment, you may also be subject to that provider's applicable terms and privacy policy. MiYo Gift does not store your full payment card number, CVV, or payment account password. We may receive transaction information needed to confirm and manage a purchase, such as a transaction reference, payment status, amount, currency, time, provider, discount information, and the Paid Benefits associated with the purchase. ### 8.3 Pricing, Currency, and Taxes The price and included benefits of a purchase are shown before you complete payment. Displayed or charged amounts may vary based on currency conversion, discounts, taxes, payment-provider rules, or other checkout factors. ### 8.4 Refunds Refunds are governed by our [Refund Policy](/refund-policy). Under the standard policy, you may request a refund within 14 calendar days after successful payment if none of the Paid Benefits included in that purchase have been used. Once a Paid Benefit has been used, the purchase is generally not eligible for a standard refund, subject to the exceptions described in the Refund Policy and any mandatory rights under applicable law. --- ## 9. Content Moderation and Service Actions MiYo Gift does not routinely pre-screen every user-created gift. We may remove or restrict content, gifts, Paid Benefits, or access to the Service if we reasonably believe that: * content violates these Terms or applicable law; * we receive a valid copyright, privacy, abuse, or legal complaint; * there is fraud, payment abuse, security risk, or misuse of the Service; or * action is reasonably necessary to protect users, recipients, third parties, or MiYo Gift. Where required or appropriate, we may preserve relevant records or cooperate with lawful requests from competent authorities. --- ## 10. MiYo Gift Intellectual Property MiYo Gift owns or licenses the website, editor, software, interface design, branding, original copy, template arrangements, visual compositions, and other platform materials that are not User Content. Except where we expressly permit it, you may not copy, reproduce, modify, distribute, sell, clone, scrape, reverse engineer, or commercially exploit MiYo Gift platform materials. Privacy and Security Our handling of personal information is described in our [Privacy Policy](/privacy-policy) and [Cookie Policy](/cookie-policy). Information about our security and gift-protection practices is available on our [Security & Privacy page](/security). Personal gift pages are not intended to be publicly indexed. We use technical controls designed to keep them out of public search indexes and to block known search and AI crawlers, but no online control can guarantee that a third party will never obtain a link or content shared by an authorized recipient. --- ## 12. Service Availability We work to keep MiYo Gift reliable, but we do not guarantee continuous, uninterrupted, error-free, or permanent availability. The Service may be affected by maintenance, upgrades, hosting or network issues, security events, payment-provider problems, email-delivery limitations, third-party service outages, force majeure events, or other circumstances outside our reasonable control. You should keep your own copies of important original photos, videos, audio, text, and other materials used in your gifts. --- ## 13. Disclaimers and Limitation of Liability To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MiYo Gift is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from circumstances outside our reasonable control, including: * loss, exposure, deletion, or corruption of User Content; * access by an unintended recipient after a gift link or password is shared, forwarded, copied, or otherwise exposed; * third-party claims arising from User Content you upload, publish, or share; * failed or delayed delivery caused by incorrect recipient information or third-party systems; * third-party payment or financial-institution processing issues; or * optional AI-generated output that you choose to use after review. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. --- ## 14. Governing Law and Disputes These Terms are governed by the laws that apply to MiYo Gift's operation and your use of the Service, subject to any mandatory consumer protections that apply where you live. If a dispute arises, please contact us first at **hi@miyogift.com** so we can try to resolve it informally. If the matter cannot be resolved, either party may pursue available remedies before a court or authority with competent jurisdiction. Nothing in these Terms limits consumer rights that cannot be waived or restricted under applicable law. --- ## 15. Changes to These Terms We may update these Terms as the Service evolves or legal requirements change. The updated version will be posted on this page with a revised "Last Updated" date.
